Terms and Conditions
1. General Terms
Ja patērētājs, izmantojot mājas lapas starpniecību iegādājas preces/pakalpojumus, tad šāda savstarpēja vienošanās tiek uzskatīta par Distances līgumu un ir pakļauta Latvijas Republikas tiesību normām, kas regulē distances līgumu tai skaitā, bet ne tikai, Latvijas Republikas „Patērētāju tiesību aizsardzības likums”, Latvijas Republikas Ministru Kabineta noteikumiem „Noteikumi par distances līgumu” u.c.
2. Making a Purchase

By entering the necessary information to complete the order, the Buyer confirms that they have read and agree that the provided data will be used by the Seller to accept the Buyer's order and carry out delivery in accordance with the regulatory requirements. By entering this information, the Buyer agrees to receive notifications related to their order via the specified email.
To make a purchase, add the desired products to the shopping cart. Fill in all the required fields and select the most suitable delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Proceed with payment to complete the order.
The order will be processed within 5-10 working days, depending on the chosen delivery method.
The Seller commits to clearly and transparently display the parameters and specifications of the offered goods.
Pārdevējam ir tiesības publicēt gatavu pēc pasūtījuma ražotu preču attēlus www.spike.lv, ja Pircējs nav sniedzis rakstisku vai mutisku lūgumu pret Pircēja pasūtīto preču bilžu publicēšanu.
3. Payment Terms
The currency for transactions on the website is euros. Payments can be made using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
Latvian internet banking payments: Swedbank, SEB, Citadele, and Luminor Visa/Mastercard card payments. When using the internet banking payment method, confirm the order and click the “Return to Merchant” button.
Personal data required for payment processing will be provided to the licensed payment institution Maksekeskus AS.
The contract becomes valid once the payment is successfully made to the online store’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after the notification.
4. Delivery Terms
Preces tiek piegādātas Latvijas robežās, izmantojot Omniva vai DPD pakomātus. Visas nodevas un nodokļus, kas jāsamaksā, lai saņemtu sūtījumu piegādes galamērķī ir jāsedz Pircējam. Piegādes izmaksas tiek parādītas, pirms pasūtījuma apstiprināšanas. Iegādātās preces tiek nogādātas Pircēja norādītajā adresē 2-4 darba dienu laikā. Izņēmuma gadījumos mums ir tiesības nosūtīt preces līdz 45 kalendāra dienām, par to informējot klientu.

5. Right of Withdrawal
The Buyer has the right to withdraw from the purchase within 14 calendar days from the receipt of the goods. (Depending on the product, the Buyer may not have mandatory withdrawal rights; in such cases, the reason must be clearly stated and explained.) Withdrawal rights do not apply if the Buyer is a legal entity.
Lai izmantotu 14 dienu atteikuma tiesības, preces drīkst izmantot tikai tām paredzētajiem mērķiem, patērētājs ir atbildīgs par preces kvalitātes un drošuma saglabāšanu atteikuma tiesību realizēšanas termiņā. Ja preces tiek nepiemēroti izmantotas vai bojātas, lietošanas laikā nevērīgi izturoties pret preci vai neievērojot instrukcijas norādījumus, ja ir nozaudēts preces oriģinālais iepakojums, vai, ja tās iepakojums ir būtiski bojāts, internetveikalam ir tiesības samazināt atmaksājamo summu atbilstoši preces vērtības samazinājumam.
To exercise the withdrawal rights, you must submit the withdrawal form, which can be obtained upon request by sending it to info@spike.lv within 14 days of receiving the goods.
The Buyer is responsible for the return shipping costs, except in cases where the reason for the return is that the product does not correspond to the order (e.g., incorrect or damaged product).
The Buyer must return the goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online store. After receiving the returned goods, the online store will refund all payments received from the Buyer within 14 days based on the Distance Contract.
The Seller has the right to withhold the payment until the goods are returned or the Buyer provides proof of the return of the goods. If the Buyer has chosen a delivery method that is more expensive than the cheapest delivery method offered by the online store, the online store is not obliged to compensate for the excess delivery costs.
The online store is not responsible for delays or failure to fulfill obligations due to circumstances beyond its reasonable control.
The online store reserves the right to refuse to sell goods and request the return of goods from the Buyer if the price listed on the website is significantly lower than the market price due to an error.
The contract becomes valid once the payment is successfully made to the online store’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after the notification.
6. Consumer Rights Regarding Non-conforming Goods
The online store is responsible for the non-conformity of goods sold to the Buyer under the contract or defects that arose within 6 months after the delivery date, or were present at the time of delivery, unless such an assumption contradicts the nature of the goods or defect. The Buyer must inform the Seller about the non-conformity of goods immediately, within 2 months of discovering the defect, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store via email at info@spike.lv.
The online store is not responsible for defects that arise after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to demand the repair or replacement of the goods free of charge.
If the goods cannot be repaired or replaced, the Seller will refund the Buyer all payments made under the Distance Contract. The Seller will provide a written response to the consumer’s complaint within 15 days.
7. Processing of Buyer’s Personal Data
The online store processes only the personal data provided by the Buyer when placing an order, such as name, surname, email, etc.
The online store provides personal data to the transport service providers to ensure the delivery of goods.
If you have expressly consented to receive marketing communications, including updates, we may occasionally contact you via email about our services and the latest offers. For this purpose, we may process your email address, which you provided when subscribing to marketing communications. The Buyer can opt-out of marketing communications by notifying us at info@spike.lv.
8. Dispute Resolution
In matters not covered by these terms and conditions, the Buyer and the Seller agree to adhere to the applicable laws of the Republic of Latvia.
Both parties will attempt to resolve any disputes between the Seller and the Buyer through mutual discussions or correspondence. If the dispute cannot be resolved through discussions or correspondence, the parties will resolve the dispute in the courts of the Republic of Latvia, in accordance with Latvian regulations. Disputes between the Buyer (consumer) and the Seller may be submitted to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.
The Buyer also has the right to address disputes to the European Union dispute resolution bodies.
